1. About Escaped Australia

Escaped Australia is operated by Dave Edwards, a sole trader based in Sydney, New South Wales, Australia (ABN 25 612 103 108). We operate a referral and curated listings platform at escaped.au that connects visitors with independent Australian experience operators.

By using our website, you agree to these terms. Please read them carefully.

2. We Are a Referral Platform — Not the Experience Provider

This is the most important thing to understand about how Escaped Australia works.

Escaped Australia is a referral and aggregator platform. We list, promote and refer bookings to independent third-party operators. We are not the provider of any experience, tour, or activity listed on this site.

When you make or enquire about a booking through Escaped Australia:

  • The contract for your experience is between you and the operator — not Escaped Australia
  • The operator is solely responsible for delivering the experience as described
  • Payments are processed by the booking platform (Rezdy or Viator) and/or the operator directly — not by Escaped Australia
  • Escaped Australia earns a referral commission from operators or booking platforms — this does not affect the price you pay

3. Independent Operators

All operators listed on Escaped Australia are independent contractors. They are not employees, agents or partners of Escaped Australia.

We take reasonable steps to vet operators before listing them, including verifying that they hold current public liability insurance. However, Escaped Australia makes no guarantee about the conduct, quality, safety record or reliability of any operator.

Operators are responsible for:

  • Delivering their experience safely and as described
  • Maintaining all required licences, insurances and legal compliance
  • Their own refund and cancellation policies
  • The accuracy of information they provide to us for listing

4. Bookings, Payments and Refunds

Bookings made through Rezdy widgets or Viator affiliate links on our site are governed by the terms and conditions of those platforms and the relevant operator.

Escaped Australia does not hold, process or refund payments. All payment disputes, cancellation requests and refund claims must be directed to the operator or the booking platform (Rezdy or Viator) through which you booked.

If an operator cancels your experience or fails to deliver what was booked, your remedies are against the operator and/or the booking platform — not Escaped Australia. We will, however, make reasonable efforts to assist you in contacting the operator if required.

5. Accuracy of Listings

We work to ensure the information on our site is accurate and up to date. However, experience details, pricing, availability and operator information can change. Always confirm current details directly with the operator before booking.

Escaped Australia is not liable for any loss arising from inaccurate, outdated or incomplete information on our site, where that information was provided to us by the operator.

6. Limitation of Liability

To the maximum extent permitted by Australian law:

  • Escaped Australia's liability to you is limited to the referral commission amount earned on your specific booking
  • We are not liable for any indirect, consequential, special or incidental loss arising from your use of our site or from an operator's failure to deliver an experience
  • Nothing in these terms excludes any right you have under the Australian Consumer Law that cannot be excluded

7. Australian Consumer Law

Nothing in these terms is intended to limit, exclude or modify any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). If any provision of these terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law prevails to the extent of the inconsistency.

8. Intellectual Property

All content on escaped.au — including text, images, logos and editorial copy — is owned by or licensed to Escaped Australia. You may not reproduce, distribute or use our content without written permission.

9. Links to Third-Party Sites

Our site contains links to third-party websites including operator sites, Rezdy and Viator. These links are provided for your convenience. Escaped Australia does not endorse and is not responsible for the content, privacy practices or terms of any third-party website.

10. Newsletter

If you subscribe to our newsletter, you agree to receive periodic emails from Escaped Australia about new experiences and updates. You can unsubscribe at any time using the link in any email. We will never sell your email address.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

We may update these terms from time to time. The current version will always be available at escaped.au/terms. Continued use of our site after any update constitutes acceptance of the revised terms.
